RESIDENT GIVEN BAIL FOR CONTRAVENING THE PUBLIC HEALTH ACT

The Abeka District Court in Accra has granted bail of GH¢ 5,000 to a resident of Akweteman in the greater Accra Region, an Electoral Area within the Okaikwei North Municipal Assembly.
The Court on Thursday 25th July, 2019 granted bail to a resident of Nii Boi Town for contravening the Public Health Act.
Moses Ansah resides at Nii Boi Town, an Electoral Area within the jurisdiction of the Okaikwei North Municipal Assembly.
The accused was charged on two counts;
Accumulation of refuse in dust bins and on bare ground contrary to Section 56 SS a & b of Act 851, Public Health Act 2012 and
Accumulation of R.P.C.’s on premises contrary to the above mentioned Act.
The Accused, Mr. Moses Ansah admitted the offences and pleaded guilty to both counts preferred against him.
He said that: “the compound has been cleared as at the time of appearing in court and said that he will no longer going to do that again.”



The judge explained to the accused to let the Assembly’s Environmental Inspectors re-inspect the premises to see whether the nuisance has really been abated and report back to court.
Moses Ansah was admitted to a bail in the sum of Gh ¢5,000 with a surety to re appear on the 8th August, 2019.
Giving the facts of the case as presented by the Assembly’s Prosecutor Madam Delight Dzansi: “Routine inspection conducted on the accused premises by the Environmental Health Inspectors on the 11th June, 2019, revealed that the accused has turned his premises (compound) into a warehouse where he’s been receiving and keeping goods and wares from traders at Lapaz. Due to these activities, there is always heap of refuse scatted all over the compound anytime there was an inspection”.
“There was accumulation of R.P.C.’s (i.e. broken tables, chairs, cardboards, cans etc.) on the accused compound which can harbor rodents and other vermin.
The madam Dzansi stated that: “Both nuisances were made known to the accused and summons were later applied for and served on him on 9th July, 2019 at which time all nuisances still existed and in its worst state”.
